Does foreign shareholding always require an FBL?
Not necessarily. First determine whether the operator is a foreigner as defined by the Foreign Business Act, then assess each actual activity and applicable market-access route. Shareholding is important information, but it does not alone answer whether every activity requires a foreign business licence (FBL).
How do the three lists relate to the two types of document?
Identify whether the activity falls within a restricted list and its specific conditions before checking whether an FBL, foreign business certificate (FBC), investment-promotion, treaty or other legal route applies. FBLs and FBCs have different legal bases and cannot be substituted simply because their names are similar.
Why must sector licences also be checked?
Foreign-business access and sector regulation operate at different levels. Even where an activity qualifies for an exemption or another access route, relevant operating, product, personnel or other licences still need examination. New activities and revenue models should be reassessed.
