Posting or sharing content in Thailand: assessing defamation and reputation risks

Consider the exact wording, the person referred to, the audience, the means of distribution and the factual background. Describing a service experience, repeating another person's allegation and asserting unlawful conduct can raise different issues. Whether someone is named is not the only consideration.

How should dissatisfaction be distinguished from an allegation against someone?

Consider the exact wording, the person referred to, the audience, the means of distribution and the factual background. Describing a service experience, repeating another person's allegation and asserting unlawful conduct can raise different issues. Whether someone is named is not the only consideration.

Does truthful content remove the need to consider risk?

Applicable defences, public interest, personal information and the method of publication also need examination. Whether something is true and whether it may be published are separate questions. Preserve supporting evidence when preparing a public complaint or response.

What if a dispute has already arisen?

Preserve the original post, link, time, comments and related correspondence rather than relying only on incomplete screenshots. THAIHOUSING can assess responses against the text and its distribution history and handle notices, negotiations and relevant civil or criminal proceedings.

How do good-faith comment and proof of truth differ?

The Thai Criminal Code addresses them separately. Good-faith expression must also fall within statutory circumstances, such as protecting legitimate interests or fair comment, to potentially fall outside defamation. Proving an allegation true concerns a separate exemption from punishment. For private matters, the law restricts proof of truth where that proof would not serve the public interest. A complaint or public response therefore requires review of the purpose, factual basis and extent of publication; 'what I said is true' is not enough to conclude that publication is safe.

How can materials be organised before posting a complaint?

Separate first-hand experience, facts supported by evidence, personal opinions and unverified accounts from others. Preserve contracts, payment records, complete conversations and the proposed post. This helps a lawyer review the material; it does not mean that a particular wording eliminates liability. THAIHOUSING can review the proposed content against the dispute history, identify points needing evidence or revised expression, and assist with subsequent communications and legal proceedings.
