Which facts should be reviewed before termination?
Verify the start date, contract, payroll cycle, reason for termination and supporting materials. Fixed terms, probation, employee misconduct and business restructuring require separate assessment. One notice and cost formula should not be applied to every termination.
Which payments and disputes need to be distinguished?
Wages and other amounts due, notice or payment in lieu, severance and disputes such as unfair dismissal are separate issues. The absence of one payment obligation does not automatically remove others. Reliance on serious misconduct also requires facts and evidence.
How should the decision be reflected in documents?
Organise assessment or incident records, applicable rules, notice, calculations and handover arrangements, checking that the documents match the actual reason. THAIHOUSING can review the procedure and settlement and handle negotiations or litigation if a dispute arises.
How should payment in lieu of proper advance notice be understood?
Where section 17/1 of the Labour Protection Act applies, payment in lieu corresponds to wages from the date the employee is required to leave to the date termination should have taken effect under section 17, paragraph two, and is payable on the departure date. It is separate from severance. Determine the dates from the payroll and notice arrangements before calculating the amount; not every case can be reduced to one month's pay.
