Inheritance With a Will in Thailand: What Still Needs to Be Done

A will can express wishes for the distribution of property, but a document setting out those wishes does not, by itself, establish that inheritance can be completed directly. Review the applicable law, the testator’s capacity, the form and content of the will, and any later amendment or revocation.

Review the will before arranging its implementation

A will can express wishes for the distribution of property, but a document setting out those wishes does not, by itself, establish that inheritance can be completed directly. Review the applicable law, the testator’s capacity, the form and content of the will, and any later amendment or revocation.

Organise the will and asset records together

Prepare the original will, death certificate, beneficiary and family relationship information, and records of assets, debts and existing arrangements. Whether the will clearly identifies property and beneficiaries also affects the steps that follow.

Establish who will administer the estate and how

Check whether the will names an estate administrator and whether a court appointment is needed for the actual administration. Where court proceedings are required, submit the relevant application and supporting documents. Having a will should not be understood as removing all other formalities, nor should every estate be described as requiring court proceedings before distribution.

Address omissions and disputes

Property not covered by the will requires a separate assessment of the applicable inheritance rules. Where the validity or content of the will, or the administrator arrangements, are disputed, identify the issues and evidence before determining the procedure. Administration must also connect debt matters, asset formalities and final distribution.
